1. Seller & Acceptance
The Service is operated by NominationPro("NominationPro", "we", "us"). By accessing or using NominationPro (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, users, and others who access the Service. You confirm that you are at least 18 years old and, if accepting on behalf of an organization, that you have authority to bind that organization.
2. Description of Service
NominationPro is a software-as-a-service platform that enables organizations to run nomination, judging, and awards programs. The Service includes branded nomination portals, role-based reviewer access, scoring tools, file attachments, and analytics.
3. Accounts
You are responsible for safeguarding your account credentials and for any activities under your account. You agree to notify us immediately of any unauthorized use. You must be at least 18 years old to create an account.
4. Subscription & Billing
Paid plans are billed in advance on a monthly or annual basis. Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all orders — Paddle handles payments, billing, tax, subscription management, invoicing, customer service inquiries relating to billing, and returns. Payment and refund mechanics are governed by Paddle's Buyer Terms. Refunds are handled in accordance with our Refund Policy. You may cancel at any time; access continues until the end of the current billing period. We reserve the right to change pricing with 30 days' notice.
5. User Content
You retain ownership of all content you submit to the Service, including nominations, attachments, and reviewer notes ("User Content"). You grant NominationPro a worldwide, non-exclusive license to host, store, and display your User Content solely to operate the Service. You are solely responsible for the legality and accuracy of your User Content.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Upload malicious code or attempt to disrupt the Service
- Harass, defame, or infringe the rights of others
- Reverse engineer or resell the Service without permission
7. Termination
We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the Service ceases immediately. You may export your data for 30 days after cancellation.
7a. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the maximum extent permitted by law, NominationPro shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the preceding 12 months.
10. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.
